Terms of Service

1. Agreement to Terms

By accessing or using Trafficninja.io ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Trafficninja.io is an AI-powered content generation platform that:

• Generates written articles and blog posts using artificial intelligence
• Provides content management and publishing tools
• Offers WordPress integration for automated content publishing
• Provides SEO analysis tools and suggestions

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

4.1 Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4.2 Account Security

• You agree to use a strong password and enable two-factor authentication if available
• You will not share your account with others
• You will not create multiple accounts to circumvent usage limits

5. Subscription Plans and Billing

5.1 Subscription Tiers

We offer multiple subscription plans with varying article generation limits:

• Basic Plan: 90 articles per month
• Professional Plan: 300 articles per month
• Enterprise Plan: 900 articles per month

5.2 Billing

• Subscriptions are billed monthly or annually based on your selected plan
• All fees are in USD unless otherwise stated
• You authorize us to charge your payment method for all fees incurred
• Subscription fees are non-refundable (see Section 6)

5.3 Auto-Renewal

• Subscriptions automatically renew at the end of each billing period
• You will be charged the then-current rate for your subscription tier
• You may cancel auto-renewal at any time before the next billing date
• Cancellation takes effect at the end of the current billing period

5.4 Usage Limits

• Each subscription plan has a monthly article generation limit
• Unused articles do NOT carry over to the next billing period
• Exceeding your limit requires upgrading to a higher-tier plan
• We reserve the right to suspend service for excessive usage beyond plan limits

5.5 Price Changes

• We reserve the right to change subscription prices with 30 days notice
• Price changes will not affect your current billing period
• Continued use after price changes constitutes acceptance of new prices

6. No Refund Policy

If you believe you have been charged in error, please contact support@trafficninja.io within 7 days of the charge.

7. AI-Generated Content

7.1 Content Ownership

• You retain all rights to the AI-generated content created through the Service
• We grant you a non-exclusive, worldwide license to use the generated content
• We do not claim ownership of content generated for your account

7.2 Content Quality and Accuracy

• AI-generated content is provided "AS IS" without warranties of any kind
• We do not guarantee the accuracy, completeness, or quality of generated content
• You are solely responsible for reviewing, editing, and fact-checking all content before publication
• We are not liable for any errors, inaccuracies, or misleading information in AI-generated content

7.3 Content Restrictions

You may NOT use our Service to generate content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, discrimination, or harassment
• Promotes violence, illegal activities, or harmful products
• Contains malware, viruses, or malicious code
• Is sexually explicit or pornographic (except where legally permitted)
• Violates privacy rights or discloses personal information without consent

7.4 Plagiarism

• While our AI strives to generate original content, we cannot guarantee 100% uniqueness
• You are responsible for checking content for plagiarism before publication
• We are not liable for any plagiarism claims arising from use of AI-generated content

8. Intellectual Property Rights

8.1 Platform Ownership

• The Service, including all software, design, text, graphics, and trademarks, is owned by Trafficninja.io
• You may not copy, modify, distribute, or reverse engineer any part of the Service
• Our name, logo, and branding are protected trademarks

8.2 User Content

• You retain ownership of any content you upload to the Service (e.g., examples, templates)
• By uploading content, you grant us a license to use it solely for providing the Service
• You represent that you have all necessary rights to upload and use any content

9. WordPress Integration

9.1 Third-Party Service

• WordPress integration is provided as a convenience feature
• We are not responsible for WordPress.com or self-hosted WordPress issues
• You are responsible for maintaining your WordPress site and credentials

9.2 Publishing Responsibility

• You are solely responsible for all content published to your WordPress site
• We are not liable for any consequences of published content
• You must comply with WordPress Terms of Service and applicable laws

10. Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to hack, disrupt, or gain unauthorized access to the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Resell or redistribute access to the Service
• Impersonate others or provide false information
• Spam, phish, or engage in fraudulent activities
• Interfere with other users' use of the Service
• Remove or obscure any copyright or proprietary notices

11. Suspension and Termination

11.1 Our Right to Terminate

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Non-payment of fees
• Excessive usage that impacts Service performance
• Any other reason at our sole discretion

11.2 No Refunds Upon Termination

• If we terminate your account for violations, you will NOT receive a refund
• You remain responsible for all fees incurred prior to termination

11.3 Your Right to Cancel

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds will be issued for the remaining portion of the billing period
• You retain access to the Service until the end of the paid period

11.4 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your account data may be deleted after 30 days
• You must cease all use of any generated content (unless you saved it)
• Any outstanding fees remain due and payable

12. Disclaimers and Limitations of Liability

12.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties of uninterrupted or error-free service
• Warranties regarding accuracy of AI-generated content

12.2 No SEO Guarantees

WE EXPRESSLY DISCLAIM ANY AND ALL GUARANTEES REGARDING:

• Search engine optimization results
• Website traffic increases
• Search engine rankings or visibility
• Keyword performance
• Conversion rates or business outcomes
• Any specific measurable results from using our content

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAFFICNINJA.IO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Costs of procurement of substitute services
• Damages arising from use or inability to use the Service
• Damages arising from AI-generated content inaccuracies
• Damages arising from third-party services (e.g., WordPress, Stripe)

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.4 Third-Party Services

• We integrate with third-party services (Stripe, WordPress, Google APIs)
• We are not responsible for the availability, accuracy, or policies of third-party services
• Your use of third-party services is subject to their respective terms

13. Indemnification

You agree to indemnify, defend, and hold harmless Trafficninja.io, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you generate and publish using the Service
• Your WordPress site or published content

14. Data and Privacy

14.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14.2 Data Security

• We implement reasonable security measures to protect your data
• However, no system is 100% secure, and we cannot guarantee absolute security
• You are responsible for maintaining the security of your account credentials

14.3 Data Retention

• We retain your data for as long as your account is active
• After account termination, we may retain data for up to 30 days for backup purposes
• We may retain certain data longer if required by law

15. Modifications to Service and Terms

15.1 Service Changes

• We reserve the right to modify or discontinue the Service at any time
• We will provide reasonable notice of material changes when possible
• Continued use after changes constitutes acceptance of modified Service

15.2 Terms Changes

• We may update these Terms at any time
• We will notify you of material changes via email or in-app notification
• Continued use after changes constitutes acceptance of new Terms
• If you disagree with changes, you must cancel your subscription

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to conflict of law principles.

16.2 Dispute Resolution

• Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation
• If negotiation fails, disputes shall be resolved through the courts of the Republic of Uzbekistan
• For international users, disputes may be resolved through international arbitration as mutually agreed

16.3 Jurisdiction

You agree to submit to the jurisdiction of the courts located in Tashkent, Uzbekistan for any legal proceedings.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Trafficninja.io.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

17.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or internet/infrastructure failures.
